Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of this website and your purchases of digital products from Bokaja (“we”, “us”, “our”). By accessing the site or placing an order, you agree to these Terms.

If you purchase through Etsy, that transaction is governed by Etsy’s terms and policies. These Terms apply to purchases made on this website.

1) Who we are

  • “Digital Products” means downloadable files (e.g., PNG clipart, bundles, PDFs, ZIP archives).
  • “Store” means this website and our WooCommerce-powered checkout.
  • “License” means the usage rights granted to you after purchase (Section 6).

3) Eligibility & Account

You must be at least 16 years old to use the Store. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4) Products, Pricing, Taxes

We may change products, pricing, and availability at any time. Prices are shown in the currency indicated at checkout and may include or exclude VAT depending on your location and applicable law. If required, VAT for digital services will be calculated at checkout based on your billing country.

5) Orders & Payment

Placing an order constitutes an offer to buy. We may accept or decline any order (e.g., for suspected fraud). Payment is processed by our payment providers; we do not store full card details. You will receive an order confirmation by email.

6) License to Use (Digital Products)

Upon full payment, we grant you a non-exclusive, non-transferable license to use the purchased Digital Products as follows, unless a product page states different terms:

Permitted (you may):

  • Use files for personal projects and small-business commercial use (e.g., posters, stickers, apparel, printables) where you create an end product for your customer.
  • Modify, combine, or overlay assets to create unique designs.
  • Use in Canva/Cricut/Silhouette or similar tools to create end products.

Not permitted (you may not):

  • Resell, share, give away, sublicense, or redistribute the source files (PNG/ZIP) “as is,” even if modified.
  • List our files or near-identical derivatives on stock sites, clipart marketplaces, or as your own clipart bundles.
  • Use in any trademark, logo, or brand mark without substantial transformation and your own legal clearance.
  • Use the files in a way that violates applicable law or third-party rights.

For POD (print-on-demand) upload-only platforms that accept raw artwork (no substantial modification), you must create a unique composition/derivative. If you need broader rights, contact info@bokaja.com.

Nothing in this License transfers copyright; all rights not expressly granted are reserved by Bokaja or its licensors.

7) Delivery & Downloads

Digital Products are delivered by instant download links shown on the order confirmation page and/or sent to your email. Keep backups of your files; we are not responsible for loss after delivery. We may set reasonable download limits to prevent abuse.

8) Refunds, Returns, Right of Withdrawal

Because Digital Products are digital content not supplied on a tangible medium:

  • If you have not started the download, EU consumers generally have a 14-day withdrawal right.
  • When you start the download or access the files immediately after purchase, you explicitly consent to immediate performance and acknowledge you lose the 14-day withdrawal right.

If a file is defective or the download link fails, contact info@bokaja.com and we’ll replace the file or restore access. Refunds may be granted at our discretion where consumer law requires. Nothing in these Terms affects your statutory rights.

9) Third-Party Services & Links (Etsy, embeds, etc.)

Our site may link to third-party services (e.g., Etsy, Discord, Pinterest, YouTube). Those services are governed by their own terms and policies. We are not responsible for their content or practices. If you purchase on Etsy, Etsy’s terms govern that order.

10) Acceptable Use

You agree not to misuse the site (e.g., attempt to gain unauthorized access, scrape content/files at scale, bypass download limits, or engage in activity that disrupts the Store).

11) Intellectual Property & Reporting

All content on the site (products, text, graphics) is protected by copyright and related rights. If you believe your rights have been infringed, email info@bokaja.com with details (URL, file name, proof of ownership); we will review promptly.

12) Warranties & Disclaimers

The site and Digital Products are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied (including fitness for a particular purpose and non-infringement). We do not guarantee uninterrupted or error-free operation.

13) Limitation of Liability

To the extent permitted by law, Bokaja will not be liable for indirect or consequential damages (loss of profits, data, business, or goodwill). Our total liability for any claim relating to a purchase will not exceed the amount you paid for that purchase in the 12 months before the claim.
This section does not limit liability that cannot be excluded under applicable law (e.g., for fraud or willful misconduct) and does not affect your consumer rights.

14) Changes to the Terms

We may update these Terms from time to time. The version posted at the time of your order applies to that order. If we make material changes to site usage terms, we will post the new version here with an updated “Last updated” date.

15) Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands, without regard to conflict of law rules. If you are an EU consumer, you may bring claims in the courts of your habitual residence as required by law.
